Terms of service

Note: these terms are a draft prepared for the launch of the site and have not been reviewed by a qualified lawyer. Consult a lawyer before relying on them.

1. General provisions

These terms set out the rules for providing services by electronic means on the website at www.planetaseniora.pl, in accordance with the Polish Act of 18 July 2002 on providing services by electronic means.

Service provider: Wojciech Sala, operating unregistered business activity under the name Planeta Seniora, email: kontakt@planetaseniora.pl.

A user is any person using the site. A facility means a care home or other residential care facility presented on the site.

2. Types and scope of services

The service provider provides the following services by electronic means:

  • A search engine for care facilities together with their profiles, photos, prices and contact details.
  • Free help choosing a facility based on a submitted enquiry form, consisting of a phone call and a set of matched suggestions.
  • A knowledge base of articles about caring for older people.
  • The ability to save facilities and compare them against each other.
  • The ability to add reviews of facilities.
  • A management panel for a facility's profile, for its owner.
  • A newsletter, once the user subscribes.

3. Conditions of use

Use of the site is free for users looking for a facility. All you need is a device with internet access and a current browser with JavaScript enabled.

Users undertake to use the site lawfully and in good faith, and in particular not to supply unlawful content.

Automated extraction of data from the site, including scraping facility profiles and reviews, is prohibited without the service provider's prior written consent.

4. Help choosing a facility

Submitting the form is free and does not oblige the user to enter into any contract.

The service provider is not a party to any contract between the user and a facility. The service provider does not provide care services, does not handle payments, and is not responsible for the quality of care provided by a facility.

The user's contact details may be passed to facilities matched to the enquiry, to the extent and for the purpose described in the privacy policy.

5. Reviews of facilities

A user may add a review of a facility. In doing so the user declares that its content is truthful and does not infringe the rights of third parties.

The rules for publishing, labelling and verifying reviews, including whether and how we check their origin, are described on the “Review verification” page.

The service provider reserves the right to remove a review that breaches the law, good practice or these terms.

6. Facility account

A facility account is created on the basis of an individual invitation sent after we verify that the person applying represents that facility.

The account holder is responsible for the accuracy and currency of the data published in the profile, in particular prices, number of places and scope of care. Publishing false data may result in suspension of the account.

The account holder is responsible for keeping their password confidential and for actions taken using their account.

7. Liability

Facility data comes from their owners or from publicly available sources. The service provider makes efforts to keep it current but does not guarantee its completeness or accuracy, in particular regarding prices and the number of free places.

Knowledge base content is informational and does not constitute legal or medical advice.

To the extent permitted by law, the service provider is not liable for decisions taken by a user on the basis of information from the site.

8. Complaints

Complaints about the operation of the site may be sent to kontakt@planetaseniora.pl.

A complaint should describe the problem and include the complainant's contact details. The service provider considers complaints within 14 days of receipt and reports the outcome to the email address given.

9. Withdrawal

Services are provided free of charge and may be discontinued by the user at any time by ceasing to use the site, deleting their account or unsubscribing from the newsletter.

A consumer who has concluded a distance contract with the service provider may withdraw from it within 14 days without giving a reason, in accordance with the Consumer Rights Act.

10. Personal data

The rules for processing personal data, the legal bases, retention periods and the rights of data subjects are set out in the privacy policy available on the site.

11. Changes to these terms

The service provider may change these terms for important reasons, in particular where the law or the scope of services changes. Changes are announced by publishing a new version on the site with an update date.

Changes take effect 14 days after publication. Continued use of the site after that date constitutes acceptance.

12. Final provisions

Matters not covered by these terms are governed by Polish law.

Consumers may use out-of-court complaint and redress procedures, including the ODR platform at ec.europa.eu/consumers/odr.
